It has been established through Supreme Court precedents that Alberta has the right to separate from Canada without requiring court approval. A constitutional referendum has been proposed, posing the question: "Do you agree that the Province of Alberta shall become a sovereign country and cease to be a province in Canada?"

In seeking judicial opinion, Alberta's Chief Electoral Officer, Gordon McClure, aims to clarify the legitimacy of a referendum on Alberta's separation. However, this matter has already been definitively addressed in the Canadian constitution, which explicitly permits a province to exit Canada. Therefore, a referendum on Alberta's separation is, in fact, aligned with the constitution's provisions.
