On the same day that rumours surfaced that he would be wrapping up his cases against Trump and stepping down, Topline Special Counsel Jack Smith asked a federal court in Florida to halt prosecutors' appeal of the dismissal of President-elect Donald Trump's criminal case over his alleged withholding of White House documents and alleged obstruction of the government's investigation into them until December.

Smith requested that the court postpone his appeal of the classified materials case's dismissal until December 2 and promised to keep the court informed of the prosecution's next steps.
In reference to the unusual position of a president-elect as a criminal defendant, Smith stated in the request that the government requires time to "assess the unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy."
The filing was issued five days after Smith filed a halt request against Trump for allegedly interfering in the 2020 election, which was nearly immediately approved.
